Abstract

Costa Rica must assume the existence of convicted persons who are innocent. To deny it would be to counteract the solid evidence of comparative law, such as the Innocent project. Accepting it, does not imply any harm. Except two consequences: First, would lead to the review of all verdicts, which is not the object of study in these notes. Second, review the evidentiary assessment procedures in the aspects that most fail, according to the modern doctrine on the test: That is, in the analysis of the credibility of the witnesses, both at the level of physical recognitions, and testimony in court.
