Abstract
In the so-called inquisitive paradigm, the collection of the evidence was usually presided over by the investigating judge, so its incorporation into the process was done in an uncritical manner.
In the adversarial, Costa Rican and Colombian process, the investigative activities, whose purpose is the incorporation of the test into the process, are carried out by a separate body from whom it has the function of judging.
At the trial stage, it is for that investigating body to convince the judge of the existence of the crime, for which it must present its evidence and it must, in turn, be introduced into the proceedings with strict observance of the procedural channels.
